My Balance® rewards contest official rules
Contest period
The My Balance® Rewards contest (the “Contest”) begins and ends on the dates and at the times posted with each prize on the My Balance® Rewards resource located through the Alberta Blue Cross® member web site (the “Web site”) (each a “Contest Period”). By participating in the Contest, each entrant agrees to abide by and be bound by these Official Rules. Entrants further agree to abide by and be bound by all decisions of ABC Benefits Corporation operating as Alberta Blue Cross® 10009 108 St. Edmonton, AB, Canada (“Sponsor”) and BestLifeRewarded Innovations 2525 Old Bronte Road, Suite 525 Oakville, ON L6M 4J2, info@bestliferewarded.com (“Prize Administrator”), which shall be final and binding, without right of appeal, in all matters relating to this Contest and the awarding of the prize(s), including without limitation eligibility and/or disqualification of entries.
Contest eligibility
In order to enter a contest inside My Balance® Rewards, you must:
- Be a legal resident of Canada and have a valid email address. Entrants who are below the age of majority in their jurisdiction of residence must have the permission of their parent or legal guardian in order to enter the Contest.
- Be a member (either primary or dependant) in good standing of a participating Alberta Blue Cross® plan both at the time of entry and as of the draw date, or have authorized access to the Web site in the 30 days prior to such membership effectiveness or 60 days following the expiration of such membership.
- Have sufficient points at the time of entry, in the amount specified on the Web site.
- Be in compliance with the Web site Terms of Use.
Excluded from eligibility are the officers, directors, employees, agents and representatives of Prize Administrator, and its parents, subsidiaries, affiliates, advertising and promotion agencies and any Contest judges (collectively, the "Promotion Entities"), and members of the immediate families (defined as parents, siblings, children and spouses, regardless of where they live) or households (whether or not related) of such officers, directors, employees, agents and representatives.
How to accumulate rewards points
- Plan members can earn points by participating in any of the activities as described on the Web site.
- Plan members can earn points via bonus codes when they become available during promotions.
- Additional points cannot be purchased and points do not have cash value.
How to enter and rules ("Rules")
- NO PURCHASE NECESSARY. Internet access and email address required. To enter a prize draw, visit the Web site and navigate to the Rewards page.
- There is no limit to the number of entries per Contest, provided that entrant has sufficient points.
- Entry is final, and once redeemed, points will therefore not be returnable or reversible.
- Entrants who have not reached the age of majority in their jurisdiction of residence must confirm that they have permission from their parent or legal guardian to enter the Contest by checking the box prior to clicking on the “submit” link.
Prizes
- There is one (1) prize available to be won in each Contest, the details of and value of which are as described on the Web site.
- Prize must be accepted as awarded and may not be substituted, transferred or redeemed for cash or otherwise, except at Sponsor’s sole discretion. Sponsor reserves the right, at its sole discretion, to substitute a prize of greater or equivalent monetary value if a prize cannot be awarded as described for any reason.
- Prize will be delivered to verified winner to one (1) address in Canada.
- Sponsor will not replace any lost or stolen prizes.
- Any other costs or expenses associated with the prize not specified herein will be the responsibility of selected winners.
- Gift cards are subject to separate terms and conditions.
Winner selection and notification
- Selected entrant will be contacted by email. In order to be declared a winner, selected entrant must: (i) submit an online Contest declaration and release form, within 60 days of it being sent by Sponsor/Prize Administrator via email, and which releases the Promotion Entities from any liability in connection with this Contest or the use, misuse, awarding or possession of any prize (the “Release”); (ii) correctly answer a mathematical skill-testing question; and, (iii) otherwise comply with these Official Rules. In the event that a potential winner is below the age of majority in his or her jurisdiction of residence, Sponsor may require the potential winner’s parent or legal guardian to ratify the potential winner’s Release.
- If a potential winner:
- does not submit the online Contest declaration and release form within 60 days
- does not correctly answer the skill-test within the time provided
- is ineligible or not in compliance with these Rules
- declines to accept the prize, or
- in the event that a prize notification or prize is returned undeliverable,
- Winner should allow 6-8 weeks for delivery of the prize.
Winner's identity
In the event of a dispute between the identity of a winner, the winner is the person who is the authorized account holder of the email address provided to Alberta Blue Cross® at the time of registering for online services. If the authorized account holder does not match the full name on the entry form or is not listed as an Alberta Blue Cross® plan member, the prize will be forfeited.
Publicity
- Sponsor and its authorized agents will collect, use, and disclose the personal information you provide when you enter the Contest for the purposes of administering the Contest and prize fulfillment.
- Sponsor operates under and complies with all applicable privacy legislation, as identified in its privacy policy as well as in the Balance® Terms of Use for this web site.
- Entry is final, and once redeemed, points will therefore not be returnable or reversible.
- Entrants who have not reached the age of majority in their jurisdiction of residence must confirm that they have permission from their parent or legal guardian to enter the Contest by checking the box prior to clicking on the “submit” link.
Right to void, terminate, suspend and modify
- Sponsor reserves the right to terminate, suspend or modify this Contest, in whole or in part, at any time and without notice or obligation if, in Sponsor's sole discretion, any factor interferes with its proper conduct as contemplated by these Official Rules. Without limiting the generality of the foregoing, if the Contest, or any part thereof, is not capable of running as planned for any reason, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, programming errors, or technical failures, which, in the sole discretion of Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor may, in its sole discretion void any suspect entries and: (a) terminate the Contest, or any portion thereof; (b) modify or suspend the Contest, or any portion thereof, to address the impairment and then resume the Contest, or relevant portion, in a manner that best conforms to the spirit of these Official Rules; and/or (c) award the prize from among the eligible, non-suspect entries received up to the time of the impairment in accordance with the winner selection criteria discussed above. No more than the stated number of prizes will be awarded.
- Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process, the operation of the Contest and/or Contest Web site, violates the Official Rules, or acts with intent to annoy, abuse, threaten or harass any other person.
Limitation of liability and releases
Except where prohibited, by participating in the Contest, each entrant agrees to release and hold harmless the Sponsor, Prize Administrator and the Promotion Entities as well as any specific parties that may be identified in the Web site (the “Released Parties”) from and against any claim or cause of action arising out of participation in any Contest, or receipt, use or misuse of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone, cellular, or network lines; (c) printing/publishing errors; (d) errors in the administration of the Contest or the processing of entries; (e) late, lost, or undeliverable mail or email; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt, use or misuse of any prize (or any goods or services for which it is redeemed). Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Contest and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages (other than for actual out-of-pocket expenses or statutory damages) and any and all rights to have damages multiplied or otherwise increased. In the event that production, technical, programming or any other reasons cause more than stated number of prizes to be claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
General conditions
All entries become the property of Sponsor and will not be returned and no correspondence will be made with or entered into except with selected entrant(s). By participating in the Contest, each entrant agrees that Sponsor, Prize Administrator and the Promotion Entities have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to the prize and specifically disclaim all such warranties, including without limitation, the implied warranties of merchantability and fitness for a particular purpose (not applicable in Quebec or Saskatchewan). Winning a prize is contingent on fulfilling all the requirements set forth herein. Mass entries, automated entries, entries submitted by third parties, and any entries or prize claims that are late, incomplete, fraudulent, illegible, unidentified or delayed will be void. All entries and prize claims are subject to verification. Proof of entry submission does not constitute proof of receipt. Entrants agree to abide by these Official Rules. Contest is subject to all applicable federal, provincial and municipal laws. Void where prohibited. Sponsor reserves the right to correct any typographical, printing, computer programming or operator errors. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, then the Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. Should a winner make any false statement(s) in any document referenced above, the winner may be required to promptly return to Sponsor his/her prize, or the cash value thereof.
WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE ASSOCIATED WITH THIS CONTEST OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
